Terms for using the hub.

These terms govern access to the Global Message Hub website, API and messaging service. Creating an account, purchasing credits or sending traffic means you accept them.

1. Acceptance

Accessing the site, purchasing credits or using the API confirms your agreement to these Terms of Use and our Refund Policy. If you do not accept them, you must not use the service. Material revisions take effect when published with a new date and version.

2. Eligibility

You must be at least 18 and legally able to enter a binding agreement. When acting for an organization, you confirm that you have authority to bind it. Account details must be accurate and kept up to date.

3. The service

Global Message Hub is a communications platform (CPaaS) operated by SHALLOW BLUE WATERS TAG FOUNDATION. It delivers SMS, RCS, WhatsApp, Voice and Email through a single API. The service is entirely digital, and features, channels or coverage may evolve over time.

4. Credits, pricing and payment

  • Prepaid credits pay for message traffic. One credit equals one SMS segment; other channels use credits per message according to channel and destination.
  • Prices are stated in USD and processed through Stripe. You are responsible for applicable taxes.
  • Credits remain valid for 12 months after purchase. The Refund Policy governs refunds.

5. Acceptable use

You are responsible for your content and for obtaining lawful recipient consent. The service must not be used for:

  • Spam, unsolicited bulk traffic or messages sent without valid consent.
  • Fraud, deception, phishing or content that distributes malware.
  • Unlawful, hateful or harassing material, or material that infringes another party's rights.
  • Traffic that conflicts with carrier rules, WhatsApp/Meta policies or applicable law.

You must respect opt-outs, applicable quiet hours and local requirements, including LGPD, GDPR and TCPA where relevant.

6. Suspension and termination

You can stop using the service at any time. We may suspend or close accounts for a breach of these terms, suspected fraud, abusive traffic, non-payment or a legal requirement. If a suspension results from our error, eligible unused credits are handled under the Refund Policy.

7. Uptime and delivery

We target the availability stated on the site and in applicable SLAs. Individual delivery also depends on carriers, device availability and recipient settings, which are not fully controlled by us; no single message is guaranteed to arrive.

8. Intellectual property

The Global Message Hub platform, brand and documentation belong to SHALLOW BLUE WATERS TAG FOUNDATION. You keep ownership of your content and data, while granting us the limited rights required to process them and provide the service.

9. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind. We do not promise uninterrupted or error-free operation and are not responsible for third-party systems, including carrier networks or WhatsApp, on which delivery may depend.

10. Limitation of liability

To the fullest extent allowed by law, our total liability related to the service is limited to the amount you paid in the three months before the claim. We are not liable for indirect, incidental or consequential losses, including lost revenue or profit.

11. Indemnification

You agree to indemnify and hold SHALLOW BLUE WATERS TAG FOUNDATION harmless against claims arising from your content, use of Global Message Hub, breach of these terms or violation of applicable law.

12. Privacy and data protection

Personal data is processed under our privacy practices and applicable law, including LGPD and GDPR. Customers can request a Data Processing Agreement. You control recipient data and we act as the processor.

13. Confidentiality

Each party must protect the other's non-public business information and use it only to perform these terms, except when disclosure is legally required or the information is already public.

14. Governing law and disputes

Brazilian law governs these terms. We first try to resolve disputes informally; email support.globalmessagehub.com@proton.me. If no resolution is reached, the courts of São Paulo, Brazil have exclusive jurisdiction, subject to mandatory consumer rights in your jurisdiction.

15. General

If one provision is invalid, the remaining provisions continue in force. A failure to enforce a right is not a waiver. You cannot assign these terms without our consent; we may assign them to an affiliate or successor. These terms and the Refund Policy form the complete agreement between us.
